Our Role in Your Booking
In most cases, we act as the agent of the Service Provider (or as a sub-agent if appointed by another agent of the Service Provider). For certain flights, however, we act as your agent when searching and booking flights (see Section 5 for more details on flight bookings).
We do not own or operate these services. When you book a Travel Service through our platform, our role is to offer information, facilitate your contract with the service provider (“Service Provider”), and arrange payment terms between you and the Service Provider. The responsibility for delivering the Travel Service lies with the Service Provider.
Your booking with us is subject to: (i) these Terms and Conditions; (ii) the terms and conditions of the applicable Service Provider; (iii) where we act as a sub-agent for the Service Provider’s appointed agent, the agent’s terms and conditions; and (iv) where the Travel Service is booked directly on the Service Provider’s website, the Service Provider’s website terms of use. A full list of the terms and conditions for each Service Provider, along with their website terms and the agents representing them, is provided in Paragraph 28. Please review all terms carefully before booking, as the Service Provider’s terms (including relevant international conventions) may limit or exclude liability.
Package Holidays
Some arrangements we assist with may be classified as “Packages” under the Package Travel and Linked Travel Arrangements Regulations 2018 (the “Package Travel Regulations”). A Package generally applies if you are a UK resident and book at least two Travel Services in a single booking that covers more than 24 hours or includes overnight accommodation. The services can include: (a) transportation, (b) accommodation, (c) motor vehicle hire, or (d) other tourist services.
If your booking includes ‘other tourist services’ along with only one of the services in (a), (b), or (c), this may still qualify as a Package if the following conditions are met:
• The ‘other tourist services’ are not integral to (a), (b), or (c),
• They are not purchased after the commencement of (a), (b), or (c),
• They represent a significant portion of the total Package (at least 25%) or are a key element of the Package.
When you book a Package, we will continue to act as an agent or sub-agent as described, meaning you will have separate contracts with each Service Provider. This type of booking is referred to as a “Multi-Contract Package” on your ATOL Certificate.
Please note that the Packages available through our platform differ from traditional pre-packaged holidays offered by tour operators under a single contract. With us, you select each Travel Service individually, entering into separate contracts with each Service Provider. Together, your bookings will form a Package if the outlined conditions are met, and you will receive an ATOL Certificate for a Multi-Contract Package if applicable.
As required by the Package Travel Regulations, we will provide assistance in specific situations as outlined in these Terms and Conditions.
Definitions of Terms
“We,” “us,” “our” refers to Luxe Getaways Ltd.
“You,” “your,” “client,” “customer refers to the individual or individuals booking a holiday package with Luxe Getaways Ltd.
“Holiday Package” refers to the travel arrangements, including accommodation, transport, and other services booked through Luxe Getaways Ltd.
“Third-party supplier” refers to airlines, hotels, car rental companies, and other suppliers providing services for the holiday package.
“Booking Confirmation” refers to the confirmation of your booking, which will be sent to you via email once payment is made and accepted.
Payment & Contract
A contract between you and Luxe Getaways Ltd. is formed once we receive a deposit or full payment for your holiday package, and we issue a Booking Confirmation.
- A deposit of £60 of is required to secure your booking. The deposit is non-refundable unless otherwise stated. Some tour providers may have different deposit requirements and you will be notified at the time of booking.
- Full payment must be made no later than 12 weeks prior to your departure date. If the full payment is not received by this deadline, we reserve the right to treat your booking as cancelled and retain your deposit.
- We accept payment via credit card, debit card, or bank transfer. You are responsible for any transaction fees that may apply.
Price Increases
While we strive to offer fixed prices once your booking is confirmed, prices are subject to change due to unforeseen circumstances, including but not limited to changes in currency exchange rates, fuel surcharges, or government taxes.
- If a price increase exceeds 10% of the original price, you will have the option to:
- Pay the increased amount and proceed with your booking.
- Cancel the booking with a full refund of all payments made to us (excluding any insurance premiums or administrative fees).
Amendment by Customer
If you wish to amend your booking after the contract is formed, you must notify us in writing as soon as possible. We will try to accommodate changes where possible but cannot guarantee that all requests can be fulfilled.
- A fee of £50 will apply for each amendment made to the booking.
- Any costs incurred by third-party suppliers due to the amendments will be added to the amendment fee.
- Significant changes, such as changing travel dates, destinations, or accommodations, may be considered a cancellation and treated accordingly (see section 5).
Cancellation by Customer
If you wish to cancel your holiday package, you must notify us immediately. The date we receive your cancellation request will determine the applicable cancellation fees, please note every travel company will have their own cancelation policy and you receive this information at the time of booking:
- More than 60 days or more before departure: loss of the deposit.
- 59 to 28 days before departure: 10% of the total holiday package cost.
- Less than 27 days before departure: 75% of the total holiday package cost.
- 13 - 0 days before departure: 100% of the total holiday package cost.
- No refunds will be issued for unused portions of the holiday package or for no-shows.
- We strongly recommend purchasing travel insurance to cover cancellation fees.
Amendment & Cancellation by Luxe Getaways Ltd.
Luxe Getaways Ltd. reserves the right to amend or cancel your holiday package under exceptional circumstances. Such circumstances may include, but are not limited to, safety concerns, natural disasters, or changes in government regulations.
- If we amend your booking and the changes are considered significant (e.g., changes to departure dates, accommodation, or travel arrangements), you will have the option to:
- Accept the amended arrangements.
- Book an alternative holiday package with us (subject to availability).
- Cancel your holiday package and receive a full refund of all payments made to us.
- In the unlikely event that Luxe Getaways Ltd. cancels your booking, we will provide a full refund of all payments made. However, we will not be liable for any additional compensation or expenses incurred by you as a result of the cancellation, except where required by law.
Ancillary Services & Extras
Luxe Getaways Ltd. offers ancillary services such as airport parking, airport lounges, excursions, transfers, theatre and attraction tickets, and other extras as an agent for third-party suppliers. When booking these services through us, your contract is directly with the third-party supplier, and their terms and conditions will apply.
- Responsibility: While Luxe Getaways Ltd. facilitates the booking of these services, we do not accept liability for the performance, quality, or provision of these ancillary services. Any issues or complaints regarding ancillary services should be directed to the relevant third-party supplier.
- Amendments & Cancellations: Changes or cancellations to ancillary services may be subject to the terms of the third-party supplier. We will assist you in making amendments where possible; however, additional fees may apply as determined by the supplier.
- Pricing & Availability: The availability and pricing of ancillary services are subject to change and may vary depending on seasonality and demand. We will notify you as soon as possible if there are any changes that affect your booking.
- Third-Party Terms: You are responsible for familiarizing yourself with the specific terms and conditions of the third-party suppliers offering the ancillary services you book. This includes, but is not limited to, conditions of carriage, cancellation policies, and any usage restrictions.
Your Responsibilities
It is your responsibility to ensure that all travel documentation (e.g., passports, visas) is up-to-date and valid for the duration of your trip.
- You must comply with all local laws, customs, and regulations of the destination country.
- If you have any special requests (e.g., dietary requirements, medical conditions), please inform us at the time of booking. We will do our best to accommodate your requests but cannot guarantee that they will be met.
Data Protection
Luxe Getaways Ltd. is committed to protecting your privacy and personal information. We collect personal data such as names, contact details, and passport information solely for the purpose of providing travel services.
- Your personal data will only be shared with third-party suppliers and authorities as required for your holiday package (e.g., airlines, hotels, and transportation providers).
- We will not share your information with any third parties for marketing purposes without your explicit consent.
- You have the right to access and correct any personal information we hold about you. For more details on how we protect your data, please refer to our [Privacy Policy].
Conditions of Carriage
Travel services provided as part of your holiday package, including flights, accommodation, and transportation, are subject to the conditions of carriage of the respective third-party suppliers.
- Airlines, cruise operators, and transport providers may have their own specific terms and conditions, which can include restrictions on baggage, cancellation policies, and liability. You are responsible for familiarizing yourself with these policies.
- Luxe Getaways Ltd. does not accept liability for any delays, cancellations, or changes in travel schedules by these third-party suppliers.
- If you are denied boarding due to overselling, visa issues, or other reasons by any carrier, we will endeavour to assist, but we are not liable for any costs or losses incurred.
Financial Protection
Luxe Getaways Ltd. is fully bonded for your financial protection under ATOL license number T7400. This means that in the unlikely event of our insolvency, you will be protected, and your money will be safeguarded.
- If your holiday includes flights, ATOL protection ensures that you will either receive a refund if your holiday has not yet started or be repatriated to the UK if you are already abroad.
- We will provide an ATOL Certificate when you book any ATOL-protected holiday package with us. Please ensure that you keep this certificate safe as it explains how the ATOL protection will apply to you and who to contact for assistance.
Liability
Luxe Getaways Ltd. acts as an agent for third-party suppliers. While we take care to select reputable suppliers, we cannot accept responsibility for the acts, omissions, or errors of these suppliers, nor can we guarantee the performance of the services provided by them.
- We will not be liable for any loss, damage, or injury that occurs as a result of your failure to comply with local laws, regulations, or safety instructions.
- Our maximum liability, if found responsible for any issues, shall not exceed the total cost of your holiday package.
Force Majeure
We will not be liable for any loss or damage caused by events outside our control, including but not limited to acts of God, war, civil unrest, terrorism, strikes, or other unforeseen circumstances that make it impossible or unsafe to travel.
Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of United Kingdom and any disputes arising from them shall be subject to the exclusive jurisdiction of the courts of United Kingdom.
By booking a holiday or any ancillary products with Luxe Getaways Ltd., you acknowledge that you have read, understood, and agree to these Terms and Conditions.
