These Booking Terms & Conditions (“Terms”) apply to all travel arrangements made through Luxe Getaways (“we”, “us”, “our”). By confirming a booking, the lead passenger (“you”, “your”) agrees to be bound by these Terms on behalf of all persons named on the booking.
1. Definitions
1.1 “We”, “Us”, “Our” means Luxe Getaways.
1.2 “You” means the lead passenger and all persons named on the booking.
1.3 “Supplier” means any third party providing travel services including airlines, hotels, tour operators and ground handlers.
1.4 “Package Holiday” has the meaning given under the Package Travel and Linked Travel Arrangements Regulations 2018.
1.5 “ATOL” refers to the Air Travel Organiser’s Licence scheme administered by the UK Civil Aviation Authority.
1.6 “Host Agency” refers to The Travel Network Group where applicable.
1. Our Capacity
1.1 Luxe Getaways may act in one of the following capacities depending on the booking:
a) As an agent for Suppliers;
b) As an organiser under ATOL via our Host Agency for dynamically packaged holidays;
c) As an intermediary facilitating flight-only or accommodation-only bookings.
1.2 Your booking confirmation will specify which arrangement applies.
2. Financial Protection
2.1 Where your booking constitutes a Package Holiday protected under a Supplier’s ATOL licence:

2.3 Certain arrangements, including flight-only or accommodation-only bookings, may not be ATOL protected. Protection details will be confirmed at time of booking.

4. Pricing and Availability
4.1 All quotations are subject to availability and change until confirmed.

5. Deposits and Payments
5.1 Deposit amounts vary depending on Supplier requirements and airline fare rules.
5.2 Full balance must be paid by the date specified in your booking confirmation.
5.3 Failure to pay the balance by the due date may result in cancellation and loss of deposit.
6. Flight-Only Bookings
6.1 Flight bookings are subject to the Conditions of Carriage of the relevant airline.
6.2 Tickets may be non-refundable unless otherwise stated.
6.3 Amendments are subject to airline penalties and fare differences.
6.4 Schedule changes are governed by the airline’s policies.
6.5 In flight-only bookings, we act solely as agent for the airline.
7. Accommodation-Only Bookings
7.1 Accommodation bookings are subject to the Supplier’s terms and cancellation policies.
7.2 Refunds and amendments are governed by the Supplier’s conditions.
7.3 No ATOL protection applies unless part of a qualifying Package Holiday.
8. Advisory and Consultation Fees
8.1 Luxe Getaways charges a non-refundable advisory fee for travel planning and consultation services. These fees are governed by our Advisory Terms, available at www.luxe-getaways.com/advisory-terms.
8.2 Advisory fees are separate from and in addition to any booking costs, supplier charges, or holiday package prices.
8.3 Payment of an advisory fee does not guarantee availability of any specific travel arrangement.
8.4 Clients are encouraged to review the Advisory Terms prior to engaging our planning services.
9. Amendments
9.1 Any amendment request may incur:

10. Cancellations
10.1 Cancellation charges depend on:

10.3 Cancellation penalties may increase closer to departure.
11. Administration and Cancellation Charges
11.1 In addition to any Supplier cancellation charges, Luxe Getaways reserves the right to apply an administration fee of £50 per booking in the event of cancellation, amendment, or transfer of any confirmed arrangement.
11.2 This fee covers the administrative costs incurred in processing changes and is non-refundable regardless of the reason for cancellation.
11.3 Where a booking is cancelled and a refund is due from the Supplier, the £50 administration fee will be deducted prior to any refund being processed.
12. Conditions of Carriage
Air travel is subject to the Conditions of Carriage of the operating airline. These conditions form part of your contract and are available on the airline’s website.
13. Travel Insurance
13.1 Comprehensive travel insurance is strongly recommended at time of booking.
13.2 You are responsible for ensuring adequate cover for cancellation, medical expenses, disruption and personal belongings.
14. Passport, Visa and Health Requirements
14.1 You are responsible for ensuring:

15. Force Majeure
15.1 We shall not be liable for failure to perform obligations due to events beyond reasonable control, including but not limited to:

16.1 Where we act as agent, liability rests solely with the Supplier.
16.2 Where bookings are made under ATOL protection, liability applies in accordance with applicable Regulations.
16.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence or any liability which cannot lawfully be excluded.
17. Data Protection
17.1 Personal data will be processed in accordance with our Privacy Policy.
17.2 Where bookings are processed through Host Agency systems, personal data may be securely processed in accordance with UK data protection law.
18. Complaints
18.1 Any issue during travel must be reported to the Supplier immediately.
18.2 If unresolved, complaints must be submitted in writing within 28 days of return.
19. Complaints Process and Timeframes
19.1 Any issue experienced during travel must be reported to the relevant Supplier at the time of occurrence to allow the opportunity for resolution.
19.2 If the matter remains unresolved, a formal written complaint must be submitted to Luxe Getaways within 28 days of your return date. Complaints received outside this timeframe may not be considered.
19.3 To ensure clients are aware of this requirement, the 28-day complaints window will be referenced in your booking confirmation documentation.

20. Governing Law and Jurisdiction
These Terms are governed by the laws of England and Wales. Any dispute shall be subject to the exclusive jurisdiction of the English courts.
